IMPORTANT: These Buyer Terms and Conditions are subject to updates. Please review them regularly.

1. Acceptance of the Buyer Terms and Conditions

These Buyer Terms and Conditions (the “Buyer Terms”) apply to all Users who use the EverLuvd mobile application and related services (collectively, the “Platform” or “Services”) to buy Products (each such User, a “Buyer”).

These Buyer Terms are a legally binding contract entered into by and between you (the “Buyer” and “User”) and EverLuvd, a company incorporated in the Kingdom of Saudi Arabia, with its registered address at Riyadh, Kingdom of Saudi Arabia and Commercial Registration No. 7051745714 (“EverLuvd”, “we”, “us” or “our”). EverLuvd is the owner and operator of the EverLuvd mobile application.

YOU MUST BE AT LEAST 18 YEARS OF AGE TO ENTER INTO ANY TRANSACTION ON THE PLATFORM. THIS PLATFORM IS NOT DIRECTED TO, AND SHOULD NOT BE ACCESSED BY, CHILDREN UNDER 13 YEARS OF AGE.

These Buyer Terms may be completed by other specific terms or policies made available on the Platform, which shall be deemed incorporated by reference. The Platform Terms of Use apply to all Users. Should any conflict arise between these Buyer Terms and any FAQ section on the Platform, these Buyer Terms shall be controlling.

Your use of the Platform and Services is also governed by the EverLuvd [Privacy Policy & Cookies Policy]([PLACEHOLDER: Link to your Privacy Policy]).

By purchasing a Product on our Platform, you accept and agree to be bound and abide by these Buyer Terms. If you do not agree to these Buyer Terms, you must not purchase any Products on our Platform.

2. Changes to the Buyer Terms

We may revise and update these Buyer Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Platform following the posting of revised Buyer Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

3. The Role and Responsibility of EverLuvd

EverLuvd acts as an intermediation platform for buying and selling used fancy dresses (“Products”). EverLuvd collects Products from Sellers, conducts verification and authenticity checks, assigns an EverLuvd authenticity tag, and publishes listings.

EverLuvd is not a reseller of the Products (unless explicitly stated for specific items EverLuvd may own) and is not a party to the contract of sale between a Buyer and Seller, except to the extent of providing its Platform and verification services. EverLuvd disclaims liability for the underlying sales contract, but is responsible for the accuracy of its own verification and authenticity tagging process as described.

EverLuvd’s verification relates to the Product’s conformity with the Seller's description (as assessed by EverLuvd) and its authenticity based on EverLuvd's expertise. While EverLuvd strives for accuracy, its verification is based on the information available and its assessment at the time of inspection. EverLuvd does not guarantee that the Product's aesthetic or functional aspects will meet all subjective expectations of the Buyer beyond the provided description and verification.

4. Placing an Order

Product pages will display information provided by the Seller and supplemented by EverLuvd’s verification. Descriptions and images aim to accurately represent the Product. Prices are displayed in Saudi Riyal (SAR) and are inclusive of Value Added Tax (VAT) on EverLuvd’s service fees, where applicable. The listed Price for the Product is set by the Seller in consultation with EverLuvd. Additional Costs such as shipping fees and any applicable Buyer Service Fee (see Article 11.3) will be indicated separately at checkout before the Buyer places an Order.

Placing an Order constitutes a binding offer to purchase the Product, subject to these Buyer Terms and acceptance by EverLuvd/the Seller. If a Product becomes unavailable after an Order is confirmed, EverLuvd will inform the Buyer and issue a full refund if payment has been made. EverLuvd may reject any Order if there is an outstanding dispute with the Buyer or if a Price error is evident.

5. "Buy Outright" or "Submit a Bid" Functionality

Buyers may purchase a Product outright at the listed price or, if applicable for a specific Product, submit a bid. If a bidding option is available:

• Bids are binding offers to purchase the Product at the bid price if the bid is accepted by the Seller and confirmed by EverLuvd.
• EverLuvd may set parameters for bidding (e.g., minimum bid increments, bid duration).
• The Seller has the right to approve or reject bids.
• The Buyer will be notified if their bid is accepted or rejected.

6. EverLuvd’s Verification & Authenticity Tag

All Products sold through EverLuvd undergo a verification process by our team to check for authenticity and conformity with the description. Verified items will carry an EverLuvd authenticity tag. This tag signifies that, to the best of EverLuvd's knowledge and based on its inspection, the item is authentic and as described. This is not an absolute guarantee from the original brand manufacturer. [Optional: EverLuvd may offer a digital report or certificate of its verification. If so, describe it here, similar to VC's Article 6.2, but emphasize it's EverLuvd's opinion, not a brand certificate, and for informational purposes for the Buyer on the Platform only.]

7. Delivery

7.1. Delivery by EverLuvd

Products are shipped to the Buyer by EverLuvd after successful verification and payment.

7.2. Delivery Time

EverLuvd will provide an estimated delivery timeframe at checkout. Typically, Products are shipped within 2-3 business days after order confirmation and payment, with delivery times depending on the carrier and Buyer's location within Saudi Arabia. The maximum dispatch time will be 7-10 business days unless otherwise communicated.

7.3. Delivery and Customs Costs

Shipping costs are borne by the Buyer and will be displayed at checkout. As all transactions are domestic within Saudi Arabia, customs duties are not applicable for shipments between Seller and Buyer within KSA. VAT on Products (if applicable based on Seller status) and on EverLuvd's fees will be handled according to Saudi tax law.

8. Consequences of Impossibility to Deliver Products

If delivery to the Buyer is impossible (e.g., incorrect address, Buyer fails to accept delivery), EverLuvd will notify the Buyer. The Product will be held for 1 month. If unclaimed or if redelivery cannot be arranged (Buyer may bear redelivery costs), EverLuvd may cancel the order, refund the Buyer (less original shipping and any return/restocking fees), and the Product may be returned to the Seller or relisted as per EverLuvd’s policy.

9. Transfer of Ownership and Risks

Ownership of the Products transfers to the Buyer once EverLuvd has received full payment and the Product has been successfully delivered to the Buyer. The risk of loss or damage to a Product transfers to the Buyer upon receipt of the Product by the Buyer or their authorized representative.

10. Receipt and Checking of an Order

The Buyer must check the apparent state of the packaging and the Product upon receipt, before acknowledging delivery to the carrier. Should there be a visible anomaly (e.g., damaged packaging, suspected tampering with EverLuvd authenticity tag), the Buyer must note this with the carrier and contact EverLuvd immediately, within 24 hours of receipt, providing details and photographic evidence. If the Buyer believes the Product does not significantly conform to its description (despite EverLuvd's verification) or suspects an authenticity issue, the Buyer must contact EverLuvd within the timeframe specified in Article 13.2.

11. Terms of Payment

11.1. General Terms of Payment

The Buyer must pay the full Price of the Product, plus all applicable Additional Costs (shipping, Buyer Service Fee), via EverLuvd’s secure payment system. Accepted payment methods include Mada, Visa, Mastercard, Apple Pay, and other payment methods as made available on the platform. EverLuvd may perform verification checks to prevent fraud. Orders may be rejected if fraudulent activity is suspected.

11.2. Currencies

All transactions on EverLuvd are processed in Saudi Riyal (SAR).

11.3. Buyer Service Fee

EverLuvd charges a Buyer Service Fee for its high-touch services, including independent verification, authenticity checks, and secure platform intermediation. This fee is added to the item's price at checkout.

The Buyer Service Fee is 10% of the item's price, with a minimum of 60 SAR and a maximum of 300 SAR. This fee includes applicable VAT and will be clearly indicated at checkout before order confirmation.

11.4. Vouchers

EverLuvd may issue promotional vouchers. Conditions for voucher use (validity, non-transferable, not redeemable for cash, applicable only to product price excluding other fees) will be specified with the voucher.

12. Statutory Warranties (Consumer Protection in KSA)

Buyers in Saudi Arabia are protected by the Consumer Protection Law and the E-Commerce Law. These laws provide rights regarding defective products, misdescription, and the right to return under specific conditions. EverLuvd will facilitate claims in accordance with these laws.

13. Claims and Returns

13.1. Non-Receipt or Late Delivery

If the Buyer does not receive the Product within 15 business days from the estimated delivery date, or if there is a significant delay beyond the initially stated timeframe without justification, the Buyer should contact EverLuvd. If the Product cannot be traced or delivered within a reasonable additional period, the Buyer may be entitled to cancel the Order and receive a full refund.

13.2. Detection of Non-Conformity or Authenticity Issues Upon Receipt

If, upon receiving the Product, the Buyer believes:

• The Product is significantly different from its description on the Platform in a way not identified by EverLuvd's verification (e.g., undisclosed major flaw, wrong size not matching label).
• The Product is suspected to be counterfeit, despite EverLuvd's authenticity tag.
  The Buyer must contact EverLuvd Customer Service within 48 hours of delivery, providing a detailed explanation and clear photographic evidence. The EverLuvd authenticity tag must be intact and untampered with.

EverLuvd will review the claim. If EverLuvd deems the claim potentially valid:

• EverLuvd may authorize the Buyer to return the Product to EverLuvd for re-examination (EverLuvd may provide a prepaid shipping label or arrange collection for valid claims).
• Upon re-examination, if the non-conformity or authenticity issue is confirmed by EverLuvd:
  • The Buyer will receive a full refund (Product Price, original shipping, Buyer Service Fee).
• If the claim is not substantiated upon re-examination (i.e., Product is found to be authentic and as described per EverLuvd's standards), the Product will be returned to the Buyer at the Buyer’s expense, or the Buyer may choose to relist it on EverLuvd (standard seller fees would then apply upon its sale).
• Products must be returned in the exact condition they were received, with all original packaging (if any from EverLuvd) and the EverLuvd authenticity tag intact.

13.3. Right to Return (Cooling-off Period - As per Saudi E-Commerce Law)

Under the Saudi E-Commerce Law, consumers have the right to return a product within seven (7) days of receipt if the product has not been used, benefited from, or damaged, and is in a condition that allows for resale, unless the product falls under specific exceptions (e.g., custom-made, perishable, intimate items if seal is broken, digital goods).

• Fancy dresses, if unworn and with all tags (including EverLuvd authenticity tag) intact, may be eligible.
• Buyer must notify EverLuvd within 7 days of receipt of their intent to return.
• Buyer will bear the cost of return shipping unless the return is due to EverLuvd’s error or a confirmed defect/authenticity issue.
• Refunds (Product price, potentially original standard shipping cost if entire order returned) will be processed after EverLuvd receives and inspects the returned Product and confirms it meets the return conditions. Any Buyer Service Fee may not be refundable for "change of mind" returns.

14. Terms Applicable to All Returns

Products must be returned to EverLuvd (not the original Seller). Products must be in the condition received, with the EverLuvd authenticity tag attached and untampered. EverLuvd is not liable for damage or loss during return transit if not using an EverLuvd-approved method. EverLuvd may reject returns or reduce refunds if Products are returned damaged, used, or with missing tags due to Buyer handling.

15. Duration and Validity

These Buyer Terms govern your activity from the moment you accept them by purchasing a Product. EverLuvd may modify these terms, with changes effective upon posting.

16. Interruption of Service and Termination

EverLuvd may temporarily suspend or permanently terminate a User's access to the Services for non-compliance with these Buyer Terms (e.g., fraudulent payment attempts, abuse of return policy). EverLuvd will notify the User.

17. Questions or Concerns

Contact EverLuvd Customer Service via info@everluvd.com or through the contact features within the Platform.

18. Mediation and Dispute Resolution

In case of a dispute between a Buyer and EverLuvd, both parties agree to first attempt to resolve it amicably. The Buyer may also file a complaint with the Saudi Ministry of Commerce. If an amicable resolution is not reached within 30 days, the dispute shall be referred to the competent authorities or courts in Saudi Arabia.

19. Applicable Law and Jurisdiction

These Buyer Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising out of or in connection with these Buyer Terms shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Kingdom of Saudi Arabia. To the fullest extent permitted by law, you waive your right to participate in any class action or other representative action.
